PRIVACY POLICY

We respect your privacy. Here's exactly what information we collect and how we use it.

Last updated: July 2026

This Privacy Policy describes how The Softball Classroom / TincherPitching.NE (“we,” “us,” or “Coach Kellee”) collects, uses, and protects information when you visit our website or book a service. We are based in Kearney, Nebraska and operate as a sole proprietorship.

1. Information We Collect

Information You Provide

When you book a lesson, register for a clinic, or contact us, we may collect:

  • Your name and your athlete's name and age
  • Email address
  • Phone number
  • Scheduling preferences and session notes
  • Payment information (processed securely through Acuity Scheduling — we do not store card numbers)

Information Collected Automatically

When you visit this website, standard web server logs and analytics tools may automatically collect:

  • Your IP address (anonymized where possible)
  • Browser type and device type
  • Pages visited and time spent on the site
  • Referring website

This data is collected in aggregate and used only to understand site traffic and improve the user experience.

2. How We Use Your Information

We use the information collected solely to:

  • Schedule and confirm lessons, clinics, and events
  • Communicate with you about your bookings and athlete progress
  • Send occasional announcements about upcoming clinics or openings (you may opt out at any time)
  • Improve the quality of coaching and the website experience

We do notsell, rent, or trade your personal information to any third party for marketing purposes, and we do not use it for targeted advertising or for any “profiling” that produces legal or similarly significant effects.

Text Messages & Phone Calls

When you provide your phone number, you agree that Coach Kellee may call or text you about scheduling, confirmations, reminders, and occasional clinic announcements. Message and data rates may apply, and message frequency varies. You can opt out of texts at any time by replying STOP or by letting us know; you may still receive non-marketing messages needed to manage a booking you have made. We do not share your phone number with third parties for their own marketing.

3. Third-Party Services

Acuity Scheduling

We use Acuity Scheduling to manage appointments and process payments. When you book a lesson, you interact with Acuity's platform. Their privacy policy governs information you provide directly to them.

Google Analytics

This website uses Google Analytics to understand how visitors interact with the site. Google Analytics collects anonymized usage data. You can opt out using the Google Analytics opt-out browser add-on.

Social Media Platforms

Links to Instagram and X (Twitter) are provided for your convenience. Visiting those platforms is subject to their respective privacy policies. We do not control data collected by those services.

4. Cookies

This website may use cookies or similar technologies for analytics purposes. No cookies are used to track you across other websites or to serve targeted advertisements. You can disable cookies in your browser settings, though some site features may not function as intended.

5. Data Retention

We retain scheduling and contact information for as long as it is needed to provide services and maintain accurate business records. If you would like us to delete your information, please contact us (see below) and we will honor your request where reasonably practicable.

6. Children's Privacy (COPPA)

Our services are directed to families with youth athletes, and our website is intended for use by parents and guardians — not by children. Consistent with the federal Children's Online Privacy Protection Act (COPPA), we do not knowingly collect personal information online directly from children under the age of 13.

Any information about a minor athlete (such as name, age, or session notes) is collected only when a parent or guardian provides it for the purpose of scheduling and coaching. We use that information solely to deliver and improve our services and do not condition a child's participation on disclosing more information than is reasonably necessary. A parent or guardian may review, request deletion of, or refuse further collection of their child's information at any time by contacting us using the details below. If we learn that we have inadvertently collected information from a child under 13 without verifiable parental consent, we will delete it promptly.

7. Security & Breach Notification

We take reasonable precautions to protect the information we hold, including using HTTPS on this website and relying on third-party payment processors with strong security standards. No method of data transmission over the internet is 100% secure, and we cannot guarantee absolute security.

In the unlikely event of a data breach affecting your personal information, we will notify affected individuals and any applicable authorities without unreasonable delay, as required by the Nebraska Financial Data Protection and Consumer Notification of Data Security Breach Act and other applicable law.

8. Your Privacy Rights

Depending on where you live — including under the Nebraska Data Privacy Act and similar state privacy laws — you may have the right to:

  • Confirm whether we process your personal data and request a copy of the information we hold about you
  • Ask us to correct inaccurate information
  • Request deletion of your personal data
  • Opt out of the sale of personal data and of targeted advertising (note: we do not sell personal data or use it for targeted advertising)
  • Opt out of any non-essential communications at any time
  • Appeal a decision we make about a privacy request

To exercise any of these rights, contact us using the information below. We will not discriminate or retaliate against you for exercising your privacy rights. We will respond within the timeframe required by applicable law (generally within 45 days), and we may need to verify your identity before acting on a request. If we deny a request, you may appeal by replying to our response, and we will inform you of the outcome.

9. Changes to This Policy

We may update this Privacy Policy from time to time. The “last updated” date at the top of this page reflects the most recent revision. Continued use of this website after changes are posted constitutes your acceptance of the updated policy.
